If you have received unwanted telemarketing calls, texts, or (recorded) robocalls your rights may have been violated. Fortunately, the Telephone Consumer Protection Act (TCPA) was enacted to protect individuals from receiving these frustrating calls and texts.


The Telephone Consumer Protection Act (“TCPA”) restricts telemarketers from using automatic calling systems and recorded voice messages to reach people, and from sending text messages to cell phones without permission. In addition, the TCPA restricts calls placed to individuals on the National Do Not Call Registry.


The TCPA allows people to get money for unsolicited calls and texts. The TCPA allows consumers to sue for illegal calls and texts, to collect between $500 and $1,500 per call or text.


When Are Robocalls Illegal?

  • Solicitations to residences using an artificial voice or a recording
  • Calling a cellphone using automated telephone equipment or an artificial or prerecorded voice
  • Failing to stop calling once a consumers asks for the calls to stop
  • Placing debt collection calls to a person who did not provide permission to receive the calls
  • Failing to honor the National Do Not Call Registry
